1. AUTHORIZATION AND LIABILITY By signing below, the customer (You) agrees to the following: Authorization to Work and Test Drive: You authorize Mitchell Motorworks LLC (MMW) and its technicians to perform the requested repairs and diagnostic services on the vehicle described above. You grant MMW permission to operate the vehicle for the purposes of diagnosis, testing, and road-testing, including on public roads, as necessary to complete the authorized services. Storage and Responsibility: You understand that your vehicle may be stored on MMW's property, including in the outside lot, prior to, during, or after service. MMW is not responsible for loss or damage to the vehicle or any items contained within it due to theft, fire, vandalism, or other causes not directly related to the performance of the authorized repairs. Customer Personal Information: You affirm that all information provided, including personal and vehicle details, is true and accurate to the best of your knowledge. You agree to provide a valid driver’s license, which may be scanned or recorded for identification and business record purposes. Refusal of Service: MMW reserves the right to refuse any service to any person or to decline any requested work that MMW determines to be unsafe, illegal, incomplete, or non-compliant with standard industry practices or MMW policies. 2. ESTIMATES AND REPAIR AUTHORIZATION Repair Authorization: MMW will not perform any repair or service that exceeds $50.00 above the estimated cost without obtaining your verbal or written authorization first. Estimates are Not Guarantees: All estimates are based on initial visual inspection and expected parts costs and labor times. The final invoice may vary due to unforeseen complications, diagnostic results, or fluctuations in parts pricing. Diagnostic Fees: You agree to pay the stated diagnostic fee ($120.00/hour) regardless of whether the recommended repair is performed by MMW. Diagnostic fees are separate from the repair labor cost and are non-refundable. 3. WARRANTY AND GUARANTEE MMW Warranty: MMW warrants its repair labor and installed parts for a period of one (1) year or 12,000 miles, whichever comes first, from the date of service, against defects in workmanship and materials. This warranty is void if the vehicle is used for racing, or if damage is caused by abuse, subsequent accidents, or improper maintenance not performed by MMW. Warranty Limitations: MMW will not warranty any repairs or parts for issues that were not diagnosed by MMW. This includes any work performed at the customer's direct request without prior MMW diagnosis. Customer-Supplied Parts (No Warranty): MMW accepts customer-supplied parts only with the understanding that MMW provides absolutely NO warranty on the function, failure, or associated labor of any customer-supplied parts. If a failure occurs with a customer-supplied part, the customer is responsible for all labor and diagnostic costs to replace the part and correct any resulting issues. 4. PAYMENT AND STORAGE FEES Payment Required for Release: Vehicles will not be released back to the customer under any circumstances without 100% full payment of the final invoice. Mechanic's Lien: Invoices not paid in full are subject to a Mechanic's Lien being placed on the vehicle as provided by Kentucky state law. You will be responsible for all costs and fees associated with the filing and collection of this lien. Storage Fees: A storage fee of $10.00 per day will be added to the final invoice for any vehicle left on the property for more than ten (10) calendar days after the date the customer is notified that diagnosis is complete or repairs are finished. Abandoned Vehicles: After thirty (30) calendar days from the date of notification, all unpaid invoices and accumulated storage fees will be added to the Mechanic's Lien claim, and the vehicle will be deemed abandoned. The vehicle may then be towed off the lot at the customer's expense and/or sold to satisfy the lien. Prior arrangements for extended storage MUST be made in writing.
